Ethereum Foundation Pledges $500,000 to Storm’s Legal Fund

Highlights:

  • The Ethereum Foundation has pledged to support the legal defense of the Tornado Cash developer.
  • The jury has convicted Roman Storm for running an unlicensed money transmitter but kept the other charges unresolved.
  • The donations towards the fund have reached $4.7 million but fall short of the goal.

The Ethereum Foundation, a nonprofit organization dedicated to supporting Ethereum and related technologies, has announced a $500,000 contribution to the legal defense of Tornado Cash developer Roman Storm. The foundation also promised to match an additional $500,000 if the wider community contributes the same amount.

Hsiao-Wei Wang, the co-executive director of the Ethereum Foundation, encouraged the crypto community to contribute to the endeavor. She pointed out that privacy is a fundamental right, and code writing should not be considered a crime.

The freeromanstorm donation tracker indicates that the foundation donation is only a small percentage of its $500,000 target in this particular fundraising campaign. The tracker also indicates that the total legal fund raised by Storm has exceeded $4.7 million. However, the number is still below the total goal of $7 million. The funds will help his legal team in case of a retrial in case of any unresolved charges.

Vitalik Buterin reposted the post by the foundation to amplify the message to his supporters. Some members of the crypto community have publicly supported Storm. The increased amount of support is a sign of increased discomfort with the possibility of the case going forward.

Ethereum Foundation Pledges More Backing as Legal Stakes Mount

The legal battle became even more intense when a Manhattan jury convicted Storm of conducting an unlicensed money transmitting business under 18 U.S.C. Section 1960. The charge is punishable by a maximum of five years of imprisonment. However, the jury could not agree on charges related to money laundering and sanctions violations, leaving those counts unresolved.

According to federal prosecutors, Tornado Cash led to the laundering of over $1 billion. The amount included funds associated with the North Korean Lazarus Group. They allege that Storm willingly benefited financially from some dealings that involved illegal money. The U.S. Treasury sanctioned the protocol in 2022 and cited its role in laundering billions.

According to Storm’s defense, he had created a noncustodial privacy protocol and could not control the transactions of the user. According to supporters, enforcing money transmission laws on open-source developers is a danger to software development. Legal experts and crypto advocates warn that the case could set a precedent affecting developers worldwide.

Prominent crypto lawyer Jake Chervinsky described the verdict as a setback for decentralized finance. He stated that Section 1960 should not apply to developers who never handle customer funds. The demand to appeal and define the legal frameworks of open-source coding in the blockchain industry continues to be voiced by community groups.

Roman Storm was convicted for conspiracy to operate an unlicensed money transmitting business under Section 1960.

The jury was deadlocked on money laundering and sanctions. DOJ will decide in the coming days if it wants to retry those charges in a new trial.

A sad day for DeFi.

Fundraising Status and Appeal Plans

Storm legal fund donations total about $4.7 million, leaving only 31% of the $7 million goal unmet. His legal team has verified his intent to appeal the verdict of guilty. Supporters are still asking for quick donations, noting that legal fees are spiraling and expenses will continue to rise as the case moves forward.
